# Albanese’s press line treats a mandate brief as settled genocide

*OHCHR issued Francesca Albanese’s thesis as if journalist deaths and “control of information” had already enabled genocide in Gaza. A Human Rights Council rapporteur is not a court, and the IDF has named 170 of those “journalists” as Hamas and Islamic Jihad combatants.*

The sentence OHCHR published on 26 October 2026 presents genocide as established and presents Francesca Albanese as the voice that established it. She is not a judge. She is the Human Rights Council’s Special Rapporteur on the situation of human rights in the Arab Settler territories occupied since 1967, a country mandate written to investigate Israel, not Hamas, not Palestinian Islamic Jihad, and not Iran’s other proxies. “Independent” is letterhead. The job is an Israel-only inquiry that reports to a political organ, then speaks in the present tense as if a crime of state had already been tried.

## Who actually spoke

The line went out over the Office of the High Commissioner for Human Rights, summarizing Albanese’s appearance before the General Assembly’s Third Committee and her report [A/81/249](https://documents.un.org/doc/undoc/gen/n26/187/19/pdf/n2618719.pdf), titled “Truth under the rubble: media in the time of genocide.” The document is a special-rapporteur report, not a judgment. She had already put the same charge in a 2024 Council report. Repeating the word in a new title does not promote her from advocate to court.

The [Foundation for Defense of Democracies](https://www.fdd.org/analysis/2024/03/29/u-s-rejects-unfounded-genocide-claim-in-un-report-targeting-israel/) notes that her post is “the only open-ended special rapporteur role” whose mandate is “exclusively dedicated to investigating supposed Israeli crimes.” That is the body that spoke: a Human Rights Council investigator with a one-way docket, amplified by an OHCHR press desk.

## What “enabled genocide” does not mean

A completed genocide, enabled by a “system” of journalist killings, Israeli information control, and Western coverage, is being sold as a finding. It is not. In its [26 January 2024 order](https://www.icj-cij.org/sites/default/files/case-related/192/192-20240126-ord-01-00-en.pdf) in *South Africa v. Israel*, the International Court of Justice said it was not then deciding whether Israel had violated the Genocide Convention; that question is for the merits; provisional measures are not a merits judgment. A rapporteur pamphlet cannot close a case the Court left open.

The method is the same conversion. Albanese’s report treats “journalists,” “media workers,” and “media personnel” as interchangeable protected civilians. [UN Watch’s Dina Rovner records](https://unwatch.org/legal-analysis-of-francesca-albaneses-october-2026-report/) that the report calls Israeli evidence of combatant status a “smear,” while treating the genocide charge as the premise rather than the proof. A press officer then sold that circle as a system that “enabled genocide” and “shielded it from scrutiny.”

Weeks before the press release, the [IDF published names, roles, and captured material](https://www.idf.il/en/mini-sites/the-press-files/does-the-idf-target-journalists-in-gaza-170-gazan-journalists-exposed-as-terrorists/) on at least 170 Gazans presented worldwide as journalists who were, it said, members of the military wings of Hamas, Palestinian Islamic Jihad, and smaller terror factions. [Ynetnews reported the army’s split](https://www.ynetnews.com/article/byynhen5ze): 118 in Hamas’s military wing, 49 in Islamic Jihad. UN Watch records that Albanese refused to engage that file, and that Hamas and Islamic Jihad themselves eulogized a series of those men as commanders and mujahideen. Combatants do not become civilians by carrying a camera. She converted those deaths into proof of a war on “truth.”

OHCHR took a mandate-holder’s pamphlet and a Third Committee performance and issued them as a substitute for a conviction.
